1. Introduction

These Terms and Conditions (“Terms”) govern the relationship between Lie Detectors Ireland (“we”, “us”, “our”) and the individual making the booking (“Booking Party”, “You”, “Examinee”). By booking a polygraph examination with us, you confirm that you have read, understood, and agreed to the following terms.

2. Booking Terms

2.1 Confirmation of Terms
By booking an examination, you confirm that you have presented these Terms in their entirety to the examinee and that all parties involved have provided their consent to the examination.

2.2 Substance Use
Examinees must not have consumed alcohol, drugs, or any controlled substances within 24 hours of the examination. If this condition is violated, the examination will not proceed.

2.3 Health Conditions
You confirm that the examinee is not pregnant, has not given birth in the last four weeks, and does not suffer from heart conditions, including but not limited to blood pressure medication or pacemaker use. The examinee must seek medical advice if applicable.

2.4 Age Requirement
You confirm that both the individual booking the examination and the examinee are at least 18 years of age.

2.5 Booking Notice
If the booking is made with less than 48 hours’ notice, the full fee is due, and all terms apply.

2.6 Changes to Bookings
Bookings may be rescheduled under the following circumstances:

  • Illness of the examiner or examinee
  • Inaccessibility of a controlled office
  • Equipment failure
  • Other unforeseen events

2.7 Rescheduling Guarantee
We guarantee that an examination will be rescheduled within 10 working days of the original test date, should the need arise due to the above reasons.

3. Examination Process

3.1 Identification
You must provide valid government-issued identification (e.g., passport, driver’s license) upon arrival for verification purposes.

3.2 Code of Conduct
Abuse, aggression, or any form of threatening behavior towards our staff will result in immediate termination of the examination. All fees paid will be retained, and rebooking will be denied.

3.3 Suspicion of Criminal Activity
If any illegal activity, bribery attempt, or unethical behavior is detected, the examination will be terminated, and all fees paid will be retained.

3.4 Countermeasures
Any attempt to influence the results of the polygraph through countermeasures will result in one warning. Repeated attempts will result in termination of the examination, with all fees retained.

3.5 Punctuality
Arriving more than 15 minutes late for the appointment will result in the cancellation of the examination, and all fees will be retained.

3.6 Validity of Questions
Only close-ended, issue-specific questions will be asked during the examination. Questions about personal beliefs, opinions, or intentions are not permitted.

3.7 Test Duration and Question Limit
Up to 8 questions may be asked, with 2-3 being case-specific. The examination includes a polygraph test complemented by the expertise of a forensic psychologist.

3.8 Reporting Domestic Violence
If domestic violence is suspected, we reserve the right to report the matter to the relevant authorities.

3.9 Test Report
Upon completion, a full written report will be provided to the person who made the booking. The report will be sent by email or, upon request, via tracked mail.

3.10 Privacy During the Examination
Only the examinee and examiner are allowed in the examination room. However, third parties may be present during the pre-test interview.

3.11 Facility Requirements
If you provide the examination venue, the room must be clean, sanitized, and free from distractions. The test must be conducted in a private space, with no interruptions or electronic distractions. We reserve the right to refuse a venue that does not meet these conditions.

4. Fees and Payment

4.1 Payment Structure
The booking requires a non-refundable deposit of €50 (including VAT). The remaining balance will be due once the Pre-Examination Questionnaire is received.

4.2 Payment Method
You authorize two payments to be made: the non-refundable deposit and the remaining balance. Payments will be processed using the same card unless prior notice is provided.

4.3 Pre-Examination Questionnaire
The Pre-Examination Questionnaire must be completed and returned within 24 hours of receiving it. Failure to do so may result in cancellation of the booking.

4.4 Payl8r Loan Plan
If using the Payl8r loan plan, the full payment must be received before the booking is confirmed. Refunds are not applicable once funds are released by Payl8r.

4.5 Final Payment Deadline
All balances must be paid at least 48 hours before the examination. Failure to meet this deadline will result in cancellation, and all fees paid will be retained.

4.6 Cancellation and Rescheduling
Cancellations made with at least 48 hours’ notice will allow the non-refundable deposit to be applied to a future booking. Cancellations within 48 hours will result in the forfeiture of the deposit, and the booking will be canceled.

4.7 Refund Policy
No refunds will be provided once the examination has been completed, regardless of the outcome (No Deception Indicated / Deception Indicated / Inconclusive).

5. Data Protection and Retention

5.1 Data Ownership
All test data, including charts, documents, and recordings, remain the property of Lie Detector Test Ireland. Data will be handled in compliance with the Data Protection Act 1998.

5.3 Retention of Evidence
If the test data is requested for use in legal proceedings, the data will be retained for a maximum of one year.

5.4 Disclosure to Authorities
In cases of suspected criminal activity, such as sexual abuse or domestic violence, we reserve the right to share test data with law enforcement or relevant authorities.

6.1 Events Outside Our Control
We are not liable for failure to perform obligations due to circumstances beyond our reasonable control, including but not limited to natural disasters, strikes, war, or terrorism.
